Lush Loses Trade Mark for Pharmaceuticals

Published: 8 October 2026
The UK Intellectual Property Office has revoked Lush’s trade mark registration for the word LUSH in respect of pharmaceutical and certain skin care products. The decision followed a revocation action in which the proprietor was unable to demonstrate genuine commercial use of the mark in the relevant classes during the five-year period preceding the application. Without sufficient evidence of use, the mark was removed from the register for those goods. The ruling underscores the strict requirements for maintaining protection through continued and documented trading activity. Registry decisions of this nature are typically published on the IPO website and may be appealed within set time limits.

Small businesses should maintain clear records of trade mark use across all registered classes to defend against non-use challenges.
