The German paint manufacturer Brillux has succeeded in a European Union trade mark opposition, leading to partial rejection of an application for the mark "Life of Colour". Officials at the EU Intellectual Property Office found that consumers could be confused into believing the mark, intended for arts and crafts items such as coloured pens and crayons, was connected to Brillux's earlier "colour your life" branding. The decision, reported in late August, highlights the risks of similarity in marks for related goods where reputation or visual association may lead to mistaken origin. The outcome leaves the contested application narrowed but does not bar all use of similar wording in unrelated fields.
