Everton Secures Partial Win in EFC Mark Opposition

Published: 2 October 2026
A UKIPO hearing officer has ruled partially in favour of The Everton Football Club Company Limited in its opposition to a figurative EFC trade mark application filed by Spanish company WLEV MOTOR, S.L. The application, published in July 2022, sought registration across classes including cosmetics, clothing, vehicles, alcoholic beverages, retail, and hospitality services. The opponent relied on its earlier EFC registration and claimed passing off rights based on use since 1999.

The decision, issued on 6 August 2026, found a likelihood of confusion for many goods and services due to the identical dominant element “EFC”, leading to refusal in those areas. However, the opposition failed for certain terms, notably some scientific apparatus in class 9 and animal hides in class 18, allowing the mark to proceed to registration for those items. No enhanced distinctiveness or reputation was established to support broader protection under section 5(3).

Small-business owners should conduct thorough clearance searches before filing, especially for abbreviated or club-related marks, to avoid partial refusals.
