UKIPO Decides KP Pharma Health Opposition

A recent fast-track opposition before the UK Intellectual Property Office saw HN Merchants Limited challenge an application by KP Pharma Health Ltd for a figurative mark covering goods and services in classes 3, 5, 9, 10 and 44. The opposition, filed in October 2025 under sections 5(2)(a) and 5(2)(b) of the Trade Marks Act 1994, relied on the opponent’s earlier “pharmahealth” registration in class 3. The proceedings focused on whether the marks were similar and the goods identical or similar enough to create a likelihood of confusion. No hearing was requested and the decision was issued on the papers on 1 July 2026.
